Sole Proprietor

Estate Planning, Trusts, Estates, Probate, and Elder Law Attorney

Monty L. Donohew

On one hand, funding the assets of a business for which you are the sole  proprietor, is simply accomplished by an assignment. The registration or title of bank accounts is sometimes problematic, and may require assistance from counsel.

Attorney Donohew typically asks that the account be registered or titled in the name of the trust, “dba ‘the business name’.” Banks may or may not permit the account in that form, however, in which event consult counsel.  We can provide a memorandum to share with your banker that provides different options, in order of preference.  Usually, the Bank will resolve the funding issues within a few days by selecting one of the provided options.
